County Council Vote to Reinstate the "Coup" Leadership Postponed to Allow Public Hearing 9/14 Hilo 6:30p.m. on this Resolution
Yesterday the County Council reverted to the pre June 16th Council organization: with Pete Hoffmann as Vice Chair, Yagong as head of Finance, and Ford as head of Public Works and Intergovernmental Relations. The Council took this action to avoid imposition of a temporary restraining order that Judge Ibarra imposed to go into affect at 6p.m. today which would have prohibited any further business by the 6/16 Council government structure. The Court indicated this TRO would be imposed because of the likelihood the WHT would prevail on the issue that the Council violated the Sunshine Law in the manner it carried out the reorganization.
Today the Council took up the same proposed reorganization (pursuant to Resolution #218-09). Everyone who testified opposed this Resolution based on legal principles, ethical and moral principles, and practical concerns. It appears the measure would nevertheless pass. However Brenda Ford then moved to hold a public hearing (to prevent the County from being put into further jeopardy) and that measure passed. (Only three votes are necessary to hold a public hearing) Because a public hearing was scheduled, the Resolution is postposed until after the hearing.The public hearing is scheduled for September 14th in Hilo at 6:30P.M. in Council Chambers.
